We received some wonderful news this morning that our client’s (“the Applicant”) Tier 2 Intra-Company Transfer visa application (as a long term worker) has been successful. The decision itself came back within 10 working days as the Applicant had purchased a priority visa appointment. This was the second time we worked with the Applicant’s Sponsor, having previously assisted the Sponsor to obtain a Tier 2 General dependent visa for one of their other workers.
Background to the Tier 2 Intra-Company Transfer visa application (as a long term worker)
We were initially contacted by the Tier 2 Sponsor who had booked a legal consultation to discuss their immigration matter. The Sponsor had informed us that they already had a Tier 2 Intra-Company Transfer worker who had extended her visa twice before. They now wished to extend her visa for a third time under the Tier 2 Intra-Company Transfer long term staff route totalling her overall duration on the visa for 9 years. We were informed that the Sponsor was an A Rated Sponsor and they were able to issue a Certificate of Sponsorship (CoS) to the Applicant, but they were not sure if she met the requirements for a Tier 2 Intra-Company Transfer visa application extension. In particular, the Sponsor had concerns regarding the financial requirement for this application. In order to be granted a further extension, the Applicant had to show that she earned a minimum of £120,000. There were some complexities as the Applicant’s salary consisted of both a base salary and performance-based commission. However, our immigration team was able to provide solutions to their problem which was instrumental in a successful application.
Apply for a Tier 2 Intra-Company Transfer visa application (as a long term worker)
To submit a successful Tier 2 Intra-Company Transfer visa application to the Home Office you must meet all the Home Office requirements under the Immigration Rules and provide evidence in support of your application. The relevant rules for a Tier 2 Intra-Company Transfer visa application can be found under Paragraph 245G of the Immigration Rules. It is crucial you submit an application that is well presented in a clear and logical manner. In our experience, caseworkers may overlook applications that are improperly prepared, for example, if there is a lack of clarity surrounding the case or where is a lack of explanation when needed.

- You must have a good character;

- Your employer must have issued you with a Certificate of Sponsorship (CoS) reference number. A COS is an electronic document which holds information about the job such as salary and length of employment. The CoS must show that you earn at least £120,000 as salary per annum; and
- You must meet the English language requirement and the maintenance requirement. You must meet the maintenance requirement by showing that you have held £945 in cash savings for 90 consecutive days before the date of your application or provide a written undertaking from your prospective employer (reflected on the CoS) confirming that they are willing to accommodate and maintain you if necessary.
