What is the Adult Dependent Relative visa?
The Adult Dependent Relative Visa is a unique visa that allows adult relatives in need of care to come to the UK on a long-term or permanent basis to live with a sponsoring relative who qualifies under the route.
Can I Sponsor a Relative for an Adult Dependent Relatives Visa?
Under the Adult Dependent Relative Visa, only a limited class of people are entitled to sponsor a relative. These include British citizens, persons settled in the UK, a person living in the UK based on refugee or humanitarian grounds, as well as those with limited leave in some circumstances according to Appendix EU.
For those based in the UK with limited leave to remain, any potential sponsorship will only extend to the duration of the sponsor’s right to remain. For those settled in the UK, however, a successful Adult Dependent Relative visa application grants an indefinite right to stay. Our team of immigration barristers and solicitors have considerable experience assisting clients in successfully applying for Adult Dependent Relatives visa. We work closely with clients to advise them on the individual merits of their case and streamline the process so that you and your loved ones are cared for in the way that they deserve promptly.
The Requirements for an Adult Dependent Relative Visa
Only an adult dependent may apply under this visa. Section E-ECDR of Appendix FM of the Immigration Rules defines an adult dependent relative as an applicant aged above 18 who is the sponsor’s parent, grandparent, sibling, or child.
Eligibility under the ADR route hinges upon the adult dependent being able to show that they require long-term personal care due to factors such as age, disability, or illness. To satisfactorily prove your case, you must show that taking care of your relative will require you to perform everyday tasks, such as washing and cooking, for them. Furthermore, you must show that the situation that necessitated such assistance in the first place must have occurred recently such as in the case of an accident or rapid deterioration.
The sponsoring carer must be able to show, through bank statements and other evidence of income, that they can adequately maintain and accommodate the sponsor in the UK without having to revert to public funds. You must also show that the dependent relative has no access to the required care in their original country. This could be due to a lack of available family- members to care for the relative or due to a lack of services that provide the required care within reasonable means.
