The Applicant’s Tier 2 General visa was granted within days from the date of her biometrics appointment. Background to Tier 2 General visa application

The Applicant was a dual Brazilian and Israeli national who we had initially helped secure entry clearance under the Tier 2 General work visa route. The Applicant was initially granted a 4-year visa and wished to extend her visa for a further 2 years. We identified that the Applicant’s employer had not applied for a new Certificate of Sponsorship (“CoS”) and the visa was set to expire before the next allocation date. We were able to assist the Sponsor to obtain a new CoS by contacting the Home Office Business Helpdesk. Our immigration team submitted detailed legal representations explaining how the Applicant met the requirements of her application. The Home Office accepted our legal submissions and granted the Applicant’s application within days from the date of her biometrics appointment.

What is a Tier 2 General visa application?

The Tier 2 General visa is a unique work visa designed to allow migrants to apply for skilled jobs that cannot be filled by British or settled workers. This category also covers migrants coming to the UK to fill jobs on the shortage of occupation list (“SoL”).

What are the requirements for a Tier 2 General visa application?

The Tier 2 General visa is a Points Based System (“PBS”) visa application where Applicants are required to score a minimum of 70 points. Applicants will be awarded points for Attributes, English Language and Maintenance. Applicants must submit an application in accordance with Paragraph 245 of the Immigration Rules. In addition to this, consideration must be given to the Home Office Policy Guidance.

Applicants must be at least 16 years old on the date of the application and must be of good character. Applicants will be awarded 50 points for Attributes if they can show that they have been offered a job with a valid CoS from an approved Tier 2 Sponsor. In some circumstances, it will be necessary for the Tier 2 Sponsor to conduct a Resident Labour Market Test (“RLMT”). The job offer must also meet the appropriate salary requirement for the job in question. Applicants will be awarded 10 points if they can show that they meet the English language requirement. Applicants will be awarded 10 points for meeting the maintenance requirement by showing that they have at least £945 in cash savings available. The funds must have been held for a consecutive 90-day period with the last statement ending no more than 31 days before the submission of the application. If an Applicant falls short of this requirement, it is possible for the Tier 2 Sponsor to certify the maintenance requirement on the Certificate of Sponsorship.

What is a Tier 2 Certificate of Sponsorship?

Applicants cannot submit a Tier 2 General visa application without a valid CoS. A CoS is an electronic document which has a unique reference number and holds personal information about the potential migrant employee, as well as information about the job such as salary, length of employment, whether the Resident Labour Market Test has been completed (if applicable) and relevant SOC code and job description. Tier 2 Applicants must have a valid CoS reference number before they can apply under the Tier 2 visa route. By assigning a CoS using the SMS Portal, the Sponsor is confirming to the best of their knowledge that the migrant is able to undertake a particular job and that they intend to do so. It is, therefore, the responsibility of the Tier 2 Sponsor Licence employer to correctly complete the details of the CoS and assign it to the relevant migrant.
