UK Visit Visa Success Story

We have recently received the exciting news that our client (“the Applicant”) has been granted entry clearance to the UK as a visitor. The Applicant instructed us having previously applied without legal assistance and therefore without a proper understanding of the UK’s Immigration Rules which resulted in the previous application being refused. However, after instructing us to prepare her fresh application with the necessary documents and information, the UK Visit Visa application was successful and she is able to come to the UK for her trip next month.  

A case for a UK Visit Visa

The Applicant was a national of Mongolia who is currently living and studying in China. The Applicant’s partner was a British and American dual national who had not resided in the UK since he was a child, and was currently working in China where he and the Applicant met and formed a relationship. The Applicant wanted to come to the UK with her partner for a short visit in order to meet members of her partner’s family who are settled in the UK. The Applicant initially made a visitor visa application herself at the beginning of this year, however, it was refused due to the Home Office not believing her to be a genuine visitor.

We arranged a Skype consultation with the Applicant and her partner and reviewed the Applicant’s initial application where we were able to highlight where the file was lacking the evidence needed to a successful application. We were then instructed to prepare a fresh application which addressed the refusal points of the initial application and provided more evidence to prove that the Applicant was, in fact, a genuine visitor who intended to visit the UK for a short period to meet some of her partner’s family. We submitted the online form and booked an appointment in Beijing for the Applicant to give her biometric information and supporting documents. The Applicant opted to pay an additional fee for the priority service, meaning her application was placed ahead of the queue and she received a fast-tracked decision. The service standard for the priority service is 5 working days, however, this can be longer if applications are incorrectly prepared, and the fee is non-refundable. What is a UK Visit Visa?

Individuals from outside the EEA and who require a visa to enter the UK can apply for a Standard Visitor visa to visit the UK for leisure, business, to take part in sports or creative events or for another reason such as to receive private medical treatment. All of the permitted activities for a visitor to the UK are contained within Appendix V of the Immigration Rules.

The Standard Visitor visa has replaced the following visit visa categories:

A standard visit visa allows Applicants to stay in the UK for up to 6 months, or 11 months if the purpose is to receive private medical treatment. For those who wish to make regular and successive visits to the UK, they can apply for a long-term multiple entry visit visa for a period of 2, 5 or 10 years.

The only way a negative decision of a visit visa can be appealed is by way of Judicial Review. This is an extremely long, complex and costly process and it is not always necessary and ideal to go down this route.
