Understanding the Tier 5 Temporary Worker (Government Authorised Exchange) Visa

Earlier this year the UK Government announced a new addition to the Tier 5 Temporary Worker Government Authorised Exchange scheme visa allowing Science research to fall within its jurisdiction. The UK Government announced the introduction of the UK Research Innovation Science, Research and Academia scheme which allows non-EEA researchers, scientists and academics to come to the UK for a period of two years.      

Who should apply for the Tier 5 Temporary Worker Government Authorised Exchange Visa?

The Tier 5 Temporary Worker Government Authorised Exchange Visa is for anyone who would like to come to the UK for a short period of time to do training, an Overseas Government Language Programme, research or fellowship through an approved government authorised Scheme. There are a number of approved Tier 5 Government Authorised exchange schemes which can be found under Appendix N of the Immigration Rules.

In order to apply for this visa, Applicants are required to find a Sponsor prior to applying and must have been assigned a Certificate of Sponsorship from a registered Sponsor Licence holder from the UK. The work, training or research (in an approved scheme) must relate to your Sponsor’s primary source of work. The Applicant must be from outside the European Economic Area (EEA) and Switzerland. In addition to this, Applicants must have £945 in savings to demonstrate that they will not be a burden on the public purse. If you are unable to show the minimum balance required for maintenance you can ask your Sponsor to certify your maintenance as long as they have an A-rated Sponsor Licence. The Home Office usually provide a decision on a Tier 5 Temporary Worker (Government Authorised Exchange) Visa within 3 weeks of the date of submission.

What can and can’t you do on the Tier 5 Temporary Worker Government Authorised Exchange Visa?

If your Tier 5 Temporary Worker Government Authorised Exchange Visa is approved Applicants can stay in the UK for up to 12 or 24 months. The length of your visa will depend on the scheme you are applying under or the time given on the Certificate of Sponsorship plus 28 days or whichever is shorter. You can arrive 14 days before the start date of your scheme.

Once you arrive in the UK on a Tier 5 Temporary Worker Government Authorised Exchange Visa you may participate in the following activities:

  • You can study if you have been assigned a certificate from an Academic Technology Approval Scheme; or
  • You can work if you have been assigned a Certificate of Sponsorship and also do a second job for up to 20 hours per week; or
  • You may be able to apply to switch into a Tier 1 Exceptional Talent visa; and
  • You can apply to bring your family members with you to the UK.

However, there are some activities which are prohibited under the Tier 5 Temporary Worker Government Authorised Exchange Visa and they are as follows:

  • You cannot apply to receive the benefit of public funds;
  • You cannot study at a Tier 4 Institution unless they are participating in one of the approved schemes; and
  • You cannot participate in or accept a permanent job.
