Success Story: Adult Dependent Relative Visa

Our skilled Immigration Solicitors were successful in obtaining an Adult Dependent Relative (“ADR”) visa for our client who is a national of the United States. Upon initial consultation, we reviewed her case and circumstances extensively and made a thorough application for an ADR visa on the basis that she suffers from Alzheimer’s and Dementia which meant she required day to day assistance from her daughter and could not live alone in the States.

She had no other family members to care for her and given her medical conditions, it was best for our client to be around familiar faces so we aided her in reuniting with her daughter here in the UK where she is now planning to settle. Our client made an in-country application and received her decision not long after. Now that she has been granted an ADR visa, she is permitted to settle in the UK with her daughter and receive the care she requires.

Apply as an adult dependent relative (family visa)

You may be eligible for indefinite leave to remain if you have a family visa as an adult dependent relative. This visa is for people being cared for by a relative in the UK. If you are granted an ADR visa under the Immigration Rules then you will be permitted to enter, and remain in the UK, indefinitely.

Eligibility for an ADR Visa

You must be over 18 and have permission to enter the UK as an adult dependent relative.

The relative looking after you must both:

  • Be settled (or settling) in the UK
  • Have enough money to support you without relying on public funds for at least 5 years from the date you entered the UK as an adult dependent relative – they (your ‘sponsor’) must complete a sponsor form to confirm this

You do not need to prove your level of English or pass the Life in the UK Test.

Requirements for an ADR Visa

In order to qualify for an ADR visa you will need to satisfy:

  • You are the parent aged 18 years or over, grandparent, brother or sister aged 18 years or over or son or daughter aged 18 years or over of a person who is in the UK and that person is over 18 and either a British citizen, settled in the UK, has limited leave to remain in the UK under Appendix EU or is a person with refugee leave or humanitarian protection status;
  • As a result of age, illness or disability, you require long-term personal care (that is help performing everyday tasks, e.g. washing, dressing and cooking);
  • You are unable, even with the practical and financial help of your family member in the UK, to obtain the required level of care in the country where you are living because it is not available and there is no person (close relative, home-help, housekeeper, nurse, carer, care or nursing home) in your country who can reasonably provide it, or because it is not affordable;
  • You will be adequately maintained, accommodated and cared for in the UK by your family member, without recourse to public funds (if your family member is a British citizen or settled in the UK, they will be required to sign a 5-year undertaking to this effect).

How to Apply?

Apply to settle at the same time as the relative who’s looking after you. Your visa will expire if they’re granted indefinite leave to remain before you. You must apply online. Once you’ve started your application, you can save your form and complete it later. You’ll be told which documents you need to provide when you apply. You can contact UK Visas and Immigration (UKVI) for more information or get in touch with our specialist immigration team in assisting you with the application.

The exact requirements you will need to satisfy for your application will vary depending on your circumstances. In order to enhance your application’s success, you may want to speak to an immigration lawyer for expert advice. Lexvisa Solicitors & Advocates can provide you with tailored advice and help you submit a thorough application.
