Settlement and Leave to Remain in the UK: Private Life Route Changes

The Home Office has recently published a Statement of Changes in Immigration Rules.  If you are looking to apply for a visa under the Private Life route, it is essential to stay updated. The changes to the Private Life Route came into effect on the 20th of June, 2022 and have now begun to apply to all Private Life visa applications. Our Immigration Team has been consulted by numerous clients who are unsure what these changes entails. This article highlights the changes and clarifies the most frequent sources of confusion.

Amongst other changes, one of the most important changes in the Rules has been the insertion of a new Appendix Private Life at replaces paragraphs 276ADE to 276DH entirely.

What Changes Does the Appendix Private Life Make?

Whilst the Appendix Private Life preserves the option to apply for limited leave to remain as well as settlement under the route, it makes one very important change: the addition of a category that now allows dependent children born in the UK to apply for leave to remain or settlement on the basis of a parent who was already on the Private Life Route. Our highly qualified team of immigration solicitors and barristers can help you navigate the recent changes to immigration rules under the Private Life Appendix so that you can make the most of this new change and focus on the most important thing: staying with your loved ones.

What are the Requirements under the Appendix Private Life?

If you are looking to apply for settlement or limited leave to remain under the Appendix Private Life, it is essential that you are aware of the requirements. Any application that fails to meet these requirements could be fatal to your case. The Home Office will see your application as invalid if you do not use the prescribed form or fail to file the requisite fees. In such circumstances, you may be denied the opportunity to appeal or to use Section 3C of the Immigration Act 1971 to ensure your stay in the UK. Our Immigration Team handles all the details for you so that you don’t have to, ensuring a seamless process so that you can continue your stay in the UK on the Private Life route.

The requirements to successfully make a visa application under the Private Life route include payment of the application fee, the Immigration Health Surcharge, proving your continuity of residence, as well as providing your biometrics and travel documents- such as a passport. Not all of these requirements may apply to you if you are able to make out a claim under Article 8 of the European Convention on Human Rights. Other requirements may relate to an applicant’s conviction record, genuineness of marriage, legality of entrance in the UK, and English language and life knowledge. Our Immigration Team is able to walk you through these various complex Immigration rules and requirements. We can accurately determine whether you may qualify under the immigration rules and what the prospects of your case are.
