Success story: UK Partner visa application granted

We recently received some delightful news that our client’s (“the Applicant) partner visa application was granted. The Applicant was switching from a Tier 2 Intra-company Transfer visa to a partner visa from within the United Kingdom. In our initial consultation with the Applicant, we discussed the issues involved and the appropriate action required. The Applicant opted to use the priority visa service and received a decision within 24 hours from the date of submission.   

Background to UK Partner visa application

The Applicant was an American national residing in the UK with her partner on the Tier 2 Intra-company transfer visa. In our initial consultation with the Applicant, she had informed us that she wanted to apply to switch into a UK partner visa. The Applicant was married to her partner who was a British national present and settled in the United Kingdom. The Applicant informed us that she was concerned that she may fall short of meeting the financial requirement. Whilst her own salary and the Sponsor’s salary both individually met the threshold requirement of £18,600 the couple could not provide some of the documents listed under Appendix FM and Appendix FM SE to the Immigration Rules. We reviewed the Applicant’s case and advised that her application was one of a complex nature but we were confident we could deliver a successful result.

What are the requirements for a UK Partner application?

A UK Partner visa application is made under the Immigration Rules. This route is open to married couples who wish to settle together in the United Kingdom. It is important the requirements under Appendix FM are met and the requisite evidence is provided in accordance with Appendix FM SE. To apply for a UK Partner visa Applicants must meet the following requirements:

  • You must be legally married and have evidence to show that the relationship is genuine and subsisting. If you are an unmarried partner you can still apply but the requirements are slightly different;
  • You must intend to reside with your partner permanently in the United Kingdom;
  • You must have suitable accommodation for yourself, your spouse and any dependents;
  • You must meet the financial requirement of £18,600 (i.e. have enough money to support yourself, your partner and any dependants without recourse to public funds). There are a number of different methods of meeting the financial requirement; and
  • You must satisfy the English language requirement.

If you are granted a partner visa, you will be given leave to enter in the UK for 30 months after which you can apply for further leave to remain if you wish to continue to remain in the UK.
