Overcoming UK Standard Visitor Visa Refusals

In recent times the Home Office has been accused of unjustly refusing UK Standard Visitor visa applications from those from particular regions. In particular, according to some practitioners, Applicants applying from Africa, middle-east and the Indian sub-continent are more likely to have their applications refused. Whilst there are claims that the Home Office is deliberately refusing applications, there is no evidence to show this. The key to a successful UK Standard Visitor visa application is submitting an application with the correct evidence. There is no fixed set of documents required, but you will be required to provide evidence based on the circumstances behind your application.

What are the requirements for UK Standard Visitor Visa applications?

The UK Standard Visitor visa has replaced the former individual visit visa categories. If you are from outside the European Economic Area (EEA) and you wish to visit the UK for leisure, business or for another reason such as private medical treatment, you can apply for a Standard Visitor visa. The application is made under the Immigration Rules and applicants are required to meet the requirements under V4.2 – V10. To meet the requirements of Standard Visitor Visa:

  • Applicants must be at least 18 years old.
  • Applicants must plan to visit the UK for a maximum of 6 months and leave at the end of that period (unless you have applied for a multiple entry visitor visas); and
  • Applicants must be able to show that you have enough money to support your stay in the UK and be able to accommodate yourself.

The Home Office will focus on the following factors:

  • Whether you have provided sufficient evidence of your intention to visit. It is not enough to provide a reason for your visit without documentary evidence; and
  • Whether you have provided sufficient evidence that you will return to your home country after your visit. It is important that you provide evidence of all your ties and connections to your home country with documentary evidence.

It is important that you submit a well-prepared application as the Standard Visitor visa does not attract a statutory right of appeal. However, in exceptional circumstances where there are Article 8 considerations, an applicant may be given a right of appeal. Alternatively, applicants can commence Judicial Review proceedings but this process is costly and extremely complex. Therefore, it is crucial applicants submit a well-prepared application with the correct supporting documents.
