Home Office Coronavirus advice for Tier 1 Entrepreneur extension applications

The Home Office has published Coronavirus advice for Tier 1 Entrepreneur extension applications. The amended advice provides flexibility for Applicants who may not meet the requirements due to the disruption caused by the pandemic. In order to apply for a Tier 1 Entrepreneur extension, you must show that you have scored 95 points under the Points Based System and satisfy the Genuine Entrepreneur Test (investment, business activity & job creation). Whilst the route is closed to new applicants, extension applications will remain open until 5 April 2023 and settlement applications until 5 April 2025. The earliest you can apply for the extension is 28 days before the expiry of your current Tier 1 Entrepreneur leave.

The Home Office has published further Coronavirus COVID-19 advice for Tier 1 Entrepreneurs whose businesses have been disrupted by the pandemic. There is no doubt the pandemic has had a devastating impact on Small and Medium-sized Enterprises (SMEs) throughout the UK. The Home Office has relaxed the job creation requirement for extension applications and businesses are no longer required to employ a minimum of 2 British/Settled workers for 12 consecutive months. The 12-month period can be made up of multiple jobs across different months. The Home Office has also confirmed that employees can be furloughed but unfortunately the furloughed period will not count towards the 12-month period.

Applicants who have not been able to employ staff for 12 months in total by the time their visa expires, can apply for a temporary extension so that they can meet the job creation requirement. These arrangements will continue to be available for applications made after 31 May 2020, where the jobs you are relying on were disrupted due to COVID-19.

How do you score 95 points for a Tier 1 Entrepreneur extension?

Applicants must score 95 points under the Points Based System to be granted a Tier 1 Entrepreneur extension. The Immigration Rules outline what the extension requirements are and the Home Office policy guidance provides detailed information on each requirement. Applicants must score 75 points for Attributes and will be awarded points for the following (where applicable):

  • Evidence of investment into the business;
  • Evidence of registration with HM Revenue and Customs as self-employed;
  • Evidence of registration with Companies House as a Director;
  • Evidence of job creation.

You will be awarded a further 10 points for showing that you have passed an English language test at an approved test provider at level B1 of CEFR or you hold a degree taught in English or you are a national of a majority speaking country. You will be awarded a further 10 points for maintenance if you can show that you have at least £945 of personal savings, which have been held for 90 consecutive days prior to the submission of your application.
