What is the Fiance Visa UK?

The Fiance Visa UK is for non-EEA nationals who intend to get married to their British or settled partner in the UK. If successful, the Applicant will have 6 months to come to the UK in order to get married. Once a marriage certificate is issued the Applicant can then apply in-country to switch into the Spouse Visa category which is valid for an initial period of 30 months. Do you need a Fiance visa to get married in the UK?

Yes and no. Migrants already in the UK with valid leave as a Tier 2 worker or Tier 4 student for example, do not need to apply for a separate visa to get married in the UK as their visa allows them to do so. However, migrants who are in the UK on a Standard Visitor Visa (including those who are “non-visa nationals”) are not allowed to get married in the UK as that is a prohibited activity under the Immigration Rules Appendix V: Visitor Rules.

For those who are outside the UK and wish to come to the UK to get married there are two options available depending on the Applicant’s future intentions. If the Applicant and Sponsor do not intend to reside together in the UK after the marriage then they should apply for the Marriage Visitor Visa.

If the couple intend to live together in the UK after they get married and therefore wish to make the UK their home, then they should apply make a Fiance Visa application. The Fiance Visa is a popular visa option and many Applicants choose to switch into the Spouse Visa category once they are married to the Sponsor.

Can you apply for a Fiance visa in the UK?

No, the Fiance Visa is an entry clearance application. This means that Applicants must apply from outside the UK as the visa will then facilitate their entry to the UK for the purpose of marrying their British or settled sponsor within the UK.

What documents do I need for a Fiance visa UK?

The requirements and documents needed for the Fiance Visa UK are found under Immigration Rules: Appendix FM Family Members and Appendix FM-SE Family Members Specified Evidence. The main requirements that need to be met through supporting documents are:

  • Relationship requirement – The applicant and sponsor must have met in person and be in a genuine and subsisting relationship
  • Intention to get marriedThe sponsor must have taken reasonable steps to give notice to marry in the UK
  • Maintenance requirementThe sponsor must meet the minimum income requirement and show that the applicant will be maintained and accommodated in the UK without recourse to public funds
  • English language requirementThe applicant must have passed a speaking and listening test at minimum level A1, or have a degree taught in English or be from a majority English speaking country.

How much is a Fiance visa UK?

At the time of writing, the Home Office fees for a Fiance Visa application is £1,523 for the standard service. For an additional fee, Applicants can pay to use a Super Priority Service in order to get a quicker decision on their application; however, this is not mandatory. If a case has complexities, it is advised that Applicants do not use this service as the application may not be decided quicker and the fee is non-refundable. Because the visa is only valid for 6 months, Applicant’s are not required to pay further fees for the Immigration Health Surcharge.

Can I work on a Fiance Visa UK?

No, undertaking work in the UK is not permitted under the Fiance Visa route as the visa is only valid for 6 months. Applicants will have to secure a Spouse Visa once they have married their sponsor in order to then be able to work (and study) in the UK.

How has Coronavirus affected my leave in the UK on the Fiance Visa?

For those who are already in the UK on a Fiance Visa whose leave expires between 24 January 2020 and 31 May 2020 and have not yet managed to get married due to Council’s closing its registry officers and cancelling all wedding ceremonies in light of the COVDI-19 outbreak, their visas may be subject to an extension. Home Office guidance states that their visas will be extended to 31 May 2020. The global situation is being constantly monitored the Home Office is keeping its website regularly updated so migrants should be checking this frequently. There is also a dedicated Coronavirus Immigration Help Centre of which migrants can contact for further information.

Fiance Visa holders who had already managed to get married in the UK should apply to extend their leave as a spouse as usual, although visa application centres are currently closed so applications will not be processed until these reopen and biometric information is provided by the Applicant.
