The Case for Entry Clearance Tier 2 (General) Visa

The Applicant was an American national who applied for entry clearance to the UK as a Tier 2 (General) migrant as he had received a provisional job offer from an A-rated Tier 2 Sponsor (“the Company”) in the UK.  The Company is a previous client of ours, who we helped successfully apply for a Tier 2 Sponsorship Licence. The Company had assigned the Applicant a valid CoS and the Applicant was then able to use this to apply for his Tier 2 (General) visa.

As we had prepared the Tier 2 Sponsorship Licence application, we already knew that the Resident Labour Market Test (“RLMT”) had successfully been completed and that the restricted CoS was properly assigned to the Applicant. Once a CoS is assigned to a migrant worker, the Tier 2 (General) Applicant has 90 days to submit the visa application to the Home Office. The Applicant wanted a quick decision so opted for the super-priority visa service from VFS Global in order to receive a decision within one working day of submitting his documents and biometric information at the visa application support centre in the USA.

Super-priority visa service Applicants should be aware that if their visa application is not properly prepared and presented or if there is an adverse immigration history or complexities within the case, then it is unlikely the application will be decided within the service standard.

Further, the super-priority visa service is only available for certain visa Applicants and at a select number of visa application support centres. What are the main requirements for an Entry Clearance Tier 2 (General) Visa Application?

As a Points Based System application, Tier 2 (General) visa Applicants will need to acquire 70 points in order for the application to be successful.

50 points for Attributes – To acquire 50 points for Attributes, Applicants must be able to show that the job offer has satisfied the RLMT, show a valid CoS number and be awarded the appropriate. It is possible to be exempt from the RLMT in certain circumstances which would need to be clearly put forward to the Home Office for the avoidance of doubt.

10 points for Maintenance – To acquire 10 points for Maintenance, Applicants must be able to show that they can be maintained and accommodated in the UK without recourse to public funds. It is possible for employers to certify their employee’s maintenance on the CoS in order to meet this requirement.

10 points for the English Language requirement – To acquire 10 points for the English Language requirement, Applicants must meet a minimum level of CEFR level B1 in reading, writing, speaking and listening or have an academic qualification that was taught in English. Applicants from majority English speaking countries can satisfy the English Language requirement by proving their nationality.
