The Global Talent visa was introduced for Applicants who are exceptionally talented or have promise in the fields of science, engineering, medicine, humanities, digital technology, arts, and culture (including film and television, fashion design and architecture). If you wish to apply for a Global Talent visa you must obtain an endorsement from a Home Office approved endorsing body. There are a number of different endorsing bodies and you must apply to an organisation that is related to your qualifying field. The endorsement will confirm that you are in fact a credible candidate with exceptional promise or talent. If your endorsement application has been erroneously refused it is possible to submit an Endorsement Review challenging the decision.  

What is the Global Talent Endorsement requirement?

Anyone who applies for a Global Talent visa must first obtain an endorsement confirming that they are in fact a credible candidate with exceptional promise or talent. The Home Office has delegated the task of assessing a candidate’s credibility to a wide range of specialist organisations that are experts in their respective fields. Therefore, Applicants must apply for an endorsement from a Home Office approved endorsing body. Every specialist sector will have its own endorsing body; hence, you must apply to an organisation that is related to your qualifying field.

What is a Global Talent Endorsement Review?

This is a mechanism available to challenge erroneous global talent endorsement decisions. Applicants can use this instrument if they believe an error has been made negligently or as a result of not reviewing all the evidence submitted. There is no charge for this review but it must be submitted within 28 days from the date of the decision. Unlike appeals to the First-tier Tribunal, there is no statutory right to an appeal for an Endorsement Review. There is no legislation covering eligibility. Therefore, all applications must be submitted in accordance with the Home Office guidance.

Who can for a Global Talent Endorsement Review?

This mechanism is available for anyone who has been refused an endorsement under the Global Talent visa. You must have strong reasons to believe an error was made or a piece of evidence you submitted was not given the correct consideration. If you believe the endorsing body has made a decision outside the scope of their power you must submit a formal complaint to the Home Office.

Who makes a decision on the Global Talent Endorsement Review?

The Home Office will review the challenge and forward this to the relevant endorsing body to reconsider its original decision. The Home Office will provide a formal response once it has consulted with the endorsing body. The Home Office will not reverse decisions made by the endorsing bodies.

How are Global Talent Endorsement Review decisions made?

Once you have submitted the Endorsement Review the Home Office will focus on the specific areas that you have asked to be reviewed. The first course of action for the Home Office would be to ensure that the correct documents were passed onto the endorsing body and the correct procedure was followed. Following this, the endorsing body will review the application again. It is not uncommon for the review to be allocated to a senior member of the team to review. It is also wise for applicants to review the Global Talent Code of Practice for Endorsing Bodies before submitting a review as this will help determine whether the endorsing body as acted outside its power.

How long will the Global Talent Endorsement Review take?

In most cases, the review will take 28-day calendar days from the date of receipt of the review request. The decision will be notified in writing by email. In some circumstances, where there are complex issues involved it may take longer and the Home Office will provide an update as to when a decision may be made. The endorsement review does not have the power to extend your immigration leave. Therefore, the onus is on the Applicant to ensure that they continue to hold valid immigration status in the UK.

If your review is dismissed you will not be entitled to a further review and the matter will be closed. However, if your review is dismissed on new grounds that were not previously present you will be given the right to apply for a further review.
