Apply for an EEA Family Permit

To make a successful EEA Family Permit Application, you must meet the Home Office’s requirements. A successful EEA Family Permit application will be made in accordance with the Immigration (European Economic Area) Regulations 2006 and the Free Movement of Person’s Directive 2004/38/EC.

An EEA Family Permit will be granted where an Applicant can demonstrate that they are from a country outside the European Economic Area (EEA) and qualifies as a family member or an extended family member under the EEA Regulations. To qualify as a family member Applicants must be able to demonstrate that they are the spouse or civil partner of an EEA national or closely related to the EEA national. Alternatively, if you do not qualify as a family member you must then demonstrate that you are an extended family member of the EEA national. An extended family member could be an unmarried partner, brother, sister, uncle, aunt amongst other close relations. The important point to note is that the Applicant will have to demonstrate that you are dependent on the EEA national or a member of their immediate household.

There are also alternative routes available for Applicants to qualify for an EEA Family Permit such as the EEA Derivative Right of Residence, Surinder Singh route or with a Retained Right of Residence.  It is important to note that the Home Office’s requirements are a set of rigorous rules. However, you should note that there are numerous ways you can satisfy these rules. It is imperative you obtain the correct guidance before submitting any application.
